These Terms and Conditions apply to all purchases of products which are sold through this website (Site) by Suffolk Craft Society, G2, The Town Hall Galleries, Ipswich, IP1 1DH, to you, the purchaser. By placing an order on this site you agree to abide by these Conditions. They do not affect your statutory rights. CONTRACT The information displayed on this Site is considered as an invitation, not as a confirmed offer for sale and may be withdrawn or revised at any time prior to our dispatching of your order. Your order constitutes your offer to us to purchase Products on these Conditions and is subject to our subsequent acceptance. Any acknowledgement of your order by us does not constitute a formal acceptance of your order. The contract is confirmed upon us dispatching your order of Products. Title to Products shall not pass from us to you until payment in full of the price in respect of such Products is received. You must ensure the information provided by you when placing your order is up-to-date, materially accurate and is sufficient for us to fulfil your order and that you have legal capacity to enter into a contract. You must be 16 years or older. By clicking on the ‘Add to basket’ button, you confirm to us that you are at least 16 years of age. WITHDRAWL OF YOUR OFFER If you wish to withdraw your offer to purchase goods from us prior to the issue of acknowledgement that is the commencement date of the order, you must notify us of this fact in writing. If you wish to correct an error made by you in your offer to purchase goods from us, you must notify us of this fact in writing as soon as possible. Under the Distance Selling Regulations, you do not have a right to cancel this agreement after the commencement date, except where the Products are defective or we are at serious fault. PAYMENT All major credit and debit cards are accepted and are treated with discretion. We will charge credit or debit cards at the time you place your order. We reserve the right to verify credit or debit card payments prior to acceptance. The prices displayed on our website are in British pounds sterling. Our prices include VAT where applicable. Prices payable for Products are those in effect at the time of dispatch or delivery, unless otherwise expressly agreed. We reserve the right to notify you of any mistakes in Product descriptions or errors in pricing prior to Product dispatch. In such event if you choose to continue with fulfilment of the order, you acknowledge that the Product will be provided in accordance with such revised description or corrected price. PRODUCT DESCRIPTIONS Every care has been taken to ensure accuracy of description, specifications, price and delivery charges of all Products. Sizes are given as a guide only. Please be aware that handmade items are subject to variations in size, colour and shape owing to the unique nature of the product. All Product specifications, illustrations and other information on the Site or made available by us are intended to represent no more than a general illustration of the Products and do not constitute a warranty that the Products will conform to the same. We will inform you as soon as possible in the event of an error in pricing or description coming to our attention. Where we notify you of such an error, you will have the option of either (i) confirming your offer to purchase subject to the corrected description, price or delivery charge, or (ii) retracting your offer to purchase and receiving a full refund of any prepayments. AVAILABILITY All Products or quotations made or referred to on this Site are subject to availability. We make every effort to ensure that items appearing on the Site are available, but cannot guarantee this and so we may have to reject your order - without liability. If we are unable to process or fulfil your order we will refund any prior payment that you have made for that item. We may keep records of orders received, acknowledgements, acceptances and other contract records for a reasonable period. You must make sure you print a copy of all such documents and these Conditions for your own records. DELIVERY We can only deliver to addresses within the United Kingdom mainland. Your order will be delivered to the “billing address”. You must check the Delivery Address on any acknowledgement or acceptance we provide and notify us without delay of errors or omissions. We can only deliver the goods to you during office hours, Monday to Friday. We are unable to specify the time at which the goods will be delivered to you. Please allow up to 14 days for delivery. Delivery timescales specified on the Site, are estimates only. We endeavour to meet such timescales, but do not undertake to dispatch Products by a particular date or dates and shall not be liable to you in respect of delays or failure to do so. If we have not delivered the products within 30 days of the date given in our acceptance you may cancel the contract and we will refund any money paid by you. You are responsible for checking Products upon delivery and verifying that they are in satisfactory condition, in accordance with their description and complete. You may at your cost return purchased Products in accordance with these Conditions or any applicable Returns Policy referred to on the Site. If you do not accept delivery of Products ordered by you within 14 days of our first attempt to deliver the Products to you, we reserve the right to charge you for any consequential storage costs reasonably incurred by us. We shall be entitled 30 days after the date for delivery to dispose of Products in such manner as we determine and may set off any proceeds of sale against any sums due from you. RETURNS If you believe that the products may be faulty, incorrect or damaged on delivery, please immediately contact us by telephone, e-mail, or in writing giving a full account of the alleged defect. If it appears to us from your report that the goods are defective, we would ask you to send the items back to us in their original packaging and we will reimburse you the cost of the postage. Please note that when returning an item, the parcel is your responsibility until it reaches us. We reserve the right to inspect the goods and to verify that the Products are defective and those defects are attributable to the Products supplied as claimed by you. If it does not appear to us that the Products returned to us are faulty, incorrect or were damaged on delivery to you, we shall return the Products to you and you shall be charged for the reasonable cost for return postage and re-delivery. If you do not accept re-delivery of Products returned to you hereunder, we reserve the right to charge you for any consequential storage costs reasonably incurred by us. If it appears to us that the Products returned to us are indeed defective or incorrect, we shall, at your option: - (i) deliver replacement Products of similar description and specification, free of charge, provided that the Products have not been modified or subject to misuse or negligence.
Suffolk Craft Society Tel: 01473 432865 DISCLAIMERS AND LIMITATION OF LIABILITY The Suffolk Craft Society sites' content, including the information, names, images, pictures, logos and icons are provided "as is" and without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. Under no circumstances will the Suffolk Craft Society be liable for any of the following losses or damage whether such losses where foreseen, foreseeable, known or otherwise: loss of data; loss of business, revenue or anticipated profits; loss of opportunity; or loss of goodwill or injury to reputation. The Suffolk Craft Society does not warrant that functions contained in this Sites content will be uninterrupted or error free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses or bugs. GENERAL We reserve the right to modify these terms without notice. No waiver of any term or condition shall be effective unless made in writing and signed by us. If for any reason any portions of these terms are determined to be illegal, unenforceable, or invalid under applicable law in the relevant jurisdiction, the remainder of these terms (to the fullest extent permitted by law) will continue in full force and effect. You are responsible for compliance with any applicable laws of the country from which you access our website. Any changes will take effect on the date they are posted onto the site (see date below) and we are not under any obligation to notify you of such changes. You will be asked to read and accept the terms and conditions each time you place an order, to ensure that you are familiar with the most current ones. June 2007
